Goesgreen Global S.R.L. is a company leading the digital transformation of the sector by combining data from various sources, introducing new concepts and business models. It specializes in digitization and management services for renewable energies. The services offered by Goesgreen Global S.R.L. on the website goesgreen.global and on all its mobile applications (hereinafter: “Sites and Services”) are intended to maximize profitability in energy sector projects.
2- Terms of Use Agreement
Hereinafter, these regulations and policies of the Sites shall be collectively referred to as the “Terms.” Any individual or entity accessing and using the Sites and Services (hereinafter: “User”) agrees to accept and be bound by these Terms and Conditions of use. Please do not access or use the Services if you do not agree to all the Terms and Conditions. Individuals of legal age with the capacity to contract may use the Sites and Services. Those using the Sites and Services on behalf of a company must have the capacity to contract on its behalf. Additionally, to use the account, the User must be active.
3- Registration and Account
By registering on our Sites and Services, you guarantee that:
- The personal or professional information requested during registration is true, accurate, current, and complete in all aspects.
- The User is not impersonating any other person or entity. We reserve the right to reject a registration request or cancel an already accepted registration, without any right to compensation. Users who have been previously disabled will not be able to register again on the Sites and Services. Furthermore, if the use of more than one account is detected, we may apply holds, debits, and/or any other measures if we believe such actions could harm other Users or Goesgreen Global S.R.L., in addition to any corresponding penalties.
4- Shipping Policy
- License Delivery:
- Software licenses will be delivered electronically to the email address provided during the purchase process.
- Delivery will occur within a maximum period of 3 days after payment confirmation.
- System Requirements:
- Before making a purchase, ensure that your system meets the minimum software requirements. We are not responsible for performance issues due to incompatible systems.
5- Return Policy
- Return Period:
- We offer a return period of 30 days from the date of purchase. Within this period, you can request a refund if you are not satisfied with the software.
- Return Conditions:
- Return requests must be submitted in writing to our customer service via email (soporte@goesgreen.energy) within the specified period
- Return Process:
- Once the return request is approved, instructions for uninstalling the software will be provided, and a refund will be issued using the same payment method used during the purchase.
- Exceptions:
- Returns will not be accepted after the specified period.
- No refunds will be issued for already used monthly subscriptions. However, you can cancel the subscription to avoid future charges.
6- Cancellation Policy
- Right of Cancellation:
- You have the right to cancel the purchase of your software subscription within 60 days from the subscription start date.
- Cancellation Process:
- To exercise the right of cancellation, notify us via email (soporte@goesgreen.energy) within the specified period, providing your name, address, and subscription details.
- Refund for Cancellation:
- In case of cancellation, we will refund the total amount paid for the subscription within 14 business days using the same payment method used during the purchase.
7- Data Privacy
We will treat all your information confidentially and only use it in accordance with our Privacy Policy. When the User makes purchases on our Sites and Services, we will ask for their personal data to identify them. We confirm that we will use the information responsibly, protecting the privacy of Users who entrust us with their data and taking the necessary measures to ensure security on our Sites and Services. 8- Security
In order to ensure that your credit, debit, or charge card is not used without your consent, we will validate the name, address, and other personal information you provide us during the ordering process by verifying and cross-referencing it with third-party databases. We may contact the User for additional security verifications or request them to complete additional checks. By accepting the Terms and Conditions, you authorize such verifications to take place. During these verifications, personal information provided by you may be disclosed to a Credit Reference Agency, which may maintain a record of this information.
9- Indemnity
The User shall indemnify Goesgreen Global S.R.L. and its related entities, as well as its directors, successors, managers, representatives, and/or employees, against any administrative or judicial claim initiated by other Users, third parties, or any relevant Authorities related to their activities on the Sites and Services. Under this responsibility, compensations, holds, or other necessary measures may be taken for the remedy of losses, damages, and harms, regardless of their nature.
10- Intellectual Property
Goesgreen Global S.R.L. and/or its related entities own all intellectual property rights over its sites, all its content, services, products, trademarks, trade names, logos, designs, images, advertising slogans, copyrights, domains, computer programs, codes, developments, software, databases, information, technology, patents, utility models, industrial designs and models, trade secrets, among others. Using our products or Sites and Services for illegal purposes, performing any kind of reverse engineering or derivative works, utilizing search or data extraction tools on our platform for reuse, and/or creating your own databases that include all or part of our content without our express authorization is prohibited. Misuse, unauthorized use, or use that contradicts current regulations and/or causes confusion or implies derogatory use that results in harm, damage, or loss to Goesgreen Global S.R.L. and/or its related entities is prohibited as well. The use of the Sites and Services also does not imply authorization to use third-party intellectual property that might be involved. In the event a User infringes upon Intellectual Property, Goesgreen Global S.R.L. may penalize the User in accordance with the provisions of these Terms and Conditions and exercise corresponding non-judicial and/or judicial actions.
11- Rates and Payment
All prices displayed on the Sites and Services include VAT (when applicable) and are accurate at the time they are entered into the system. However, we reserve the right to change prices at any time without prior notice. Payment can be made using any commonly accepted credit or debit card. Payment will be due and charged to your account prior to the provision of the service. If your credit or debit card payment does not process successfully for any reason, we reserve the right to attempt to process the payment again within 48 hours. If payment still doesn’t go through successfully, we will inform you of any future attempts to process the payment by sending an email to the address you provided. If you do not want us to retry processing the payment, you must cancel your order in advance. In the exceptional case that the price displayed on the Sites and Services is incorrect and this fact is discovered before we accept your order, we are not obligated to sell you those items at the incorrectly displayed price. We always strive to ensure that the prices of goods displayed on the website are correct, but errors can sometimes occur. If we discover an error in the price of the product or service you have purchased, we will let you know as soon as possible and give you the option to confirm the order at the correct price or cancel it. In the case of purchasing a subscription, it will continue until you cancel it. To use the Sites and Services that require a subscription, you must provide one or more valid and accepted forms of payment, which may be periodically updated and which support payments through your account with third parties. Unless you cancel your subscription before the billing date, you authorize us to charge the membership fee for the next billing cycle to your payment method. We may offer various subscription plans, including options provided through third parties with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. The User confirms that the credit or debit card used is theirs. If the issuer of your payment card declines or for any reason does not authorize the payment, we will not be liable to you for any delay or non-delivery of any product or service. Please familiarize yourself with these Terms and Conditions before making any payment, as we reserve the right to reject or cancel any payment that does not comply with them, even if a charge has been made to your credit or debit card.
12- General Provisions
Subject to any additional Agreement, these Terms constitute the entire agreement between the User and Goesgreen Global S.R.L. regarding the use of the Sites and Services, and they govern and supersede any prior agreement, oral or written, related to the same subject matter. If any provision of these Terms is deemed invalid or unenforceable, that provision will be removed, and the remaining provisions will be deemed valid and enforceable. Headings are for reference purposes only and do not in any way define, limit, construe, or describe the scope or extent of such clause.
13- Applicable Law and Jurisdiction
These Terms and Conditions are governed by Spanish law. For all purposes related to these Terms and Conditions and the use of the Sites and Services, Goesgreen Global S.R.L. with VAT ID B56138449 establishes its registered office at Calle de la Nieve 1 Piso 1 Oficina M Tres Cantos, Madrid, Spain.
